CREW V. U.S. DEPARTMENT OF EDUCATION (SUSAN LANDRY)

14 Nov 2007 // Citizens for Responsibility and Ethics in Washington (CREW) filed a lawsuit against the Department of Education (DOE) in the District court for the District of Columbia. The lawsuit was filed in response to DOE's failure to produce documents pursuant to a CREW Freedom of Information Act (FOIA) request concerning Dr. Susan Landry. The complaint also addressed the agency's pattern and practice of refusing to respond to CREW's FOIA requests on the ground that they are not comprehensible and denying CREW a waiver of fees under the FOIA. The DOE claimed, for example, that a FOIA request seeking email communications was not comprehensible at the same time that another agency processed an identical request.
